SERVICE AGREEMENT
Effective Date: January 1, 2026
This Service Agreement (“Agreement”) is entered into between you (“Seller,” “you,” or “Customer”) and Atoban.com (“Atoban,” “we,” “us,” or “our”). By submitting a vehicle for listing, paying the setup fee, or using Atoban’s services, you agree to the terms below.
1. Scope of Services
Atoban provides managed private-sale representation for vehicle sellers.
Our services may include:

Pricing analysis and market-based recommendations

Professional listing creation and advertising placement

Publication across relevant buyer channels, which may include Facebook Marketplace, OfferUp, Craigslist, and other platforms as appropriate

Buyer inquiry management, screening, and negotiation

Privacy protection and controlled buyer introductions

Guidance on payoff, title transfer, and closing documentation
Important: Atoban is not a dealer, broker, or buyer. We do not purchase vehicles, take ownership, inspect vehicles, or guarantee results. All sales are private transactions solely between the seller and the buyer.
2. Fees & Payment Terms
Setup Fee
A $99 one-time setup fee is required to activate a managed listing.
This fee covers listing setup, advertising placement, and vehicle history reporting.
The setup fee is non-refundable once services begin.
Success Fee
Atoban charges a 3% success fee based on the final sale price of the vehicle.
The success fee is due only if the vehicle sells to a buyer introduced through Atoban.
Payment Authorization
You authorize Atoban to securely store your payment method and charge the applicable success fee on the confirmed date of sale.
3. Managed Listing Period
Each listing is managed for a defined period, generally 45 days, subject to market response.
Atoban may recommend pricing adjustments during this period.
If a seller declines to adjust pricing against market feedback, Atoban may pause or conclude active management of the listing.
Atoban does not guarantee a sale, a specific price, or a timeframe.
4. Seller Responsibilities
You agree to:

Provide accurate and truthful vehicle information

Disclose known issues, damage, or title status

Maintain a valid payment method on file

Notify Atoban within 24 hours if the vehicle sells or is otherwise withdrawn

Not divert or complete a sale with an Atoban-introduced buyer outside the platform to avoid fees
Failure to comply may result in fees or removal of the listing.
5. Vehicle Eligibility
Vehicles must be:

Running and in sellable condition unless otherwise disclosed

Accurately represented in mileage, condition, and history
-
Legally transferable under applicable state and federal laws
Atoban reserves the right to refuse, pause, or remove any listing at its discretion.
6. No Guarantee of Sale
Atoban does not guarantee that a vehicle will sell, sell within a specific timeframe, or sell for a specific price. Market demand, pricing, and vehicle condition all affect outcomes.
7. Limitation of Liability
Atoban is not a party to the vehicle transaction and is not responsible for disputes, claims, fraud, warranties, or damages arising between buyers and sellers.
To the maximum extent permitted by law, Atoban’s liability is limited to the amount of fees paid to Atoban for the applicable listing.
8. Chargebacks & Misuse
If you dispute a valid fee and Atoban prevails, you agree to reimburse Atoban for any processor fees plus a 3% administrative fee.
Misrepresentation, fraud, or misuse of the service may result in removal of the listing and additional fees.
9. Governing Law & Dispute Resolution
This Agreement is governed by the laws of the jurisdiction where Atoban is registered.
Any disputes must first be attempted to be resolved informally.
If unresolved, disputes shall be resolved through binding arbitration.
10. Amendments
Atoban may update this Agreement at any time. Continued use of the service constitutes acceptance of the updated terms.
