Welcome to Atoban.com (the “Website”). These Terms of Service (“Terms”) govern your access to and use of Atoban’s website, platform, and services. By accessing the Website, submitting a vehicle, creating an account, or using Atoban’s services, you agree to be bound by these Terms.
If you do not agree, do not use the Website or services.
1. Nature of the Service
Atoban provides managed private-sale representation services for vehicle sellers. Atoban is not a dealer, broker, auctioneer, lender, or buyer.
Atoban does not:

Purchase vehicles

Take ownership or possession of vehicles

Inspect or appraise vehicles
-
Guarantee sales, prices, or timeframes
All vehicle transactions are private-party sales conducted solely between sellers and buyers.
2. Eligibility & Accounts
You must be at least 18 years old and legally able to enter contracts to use Atoban’s services.
Certain features require you to create an account. You agree to:

Provide accurate, complete, and current information

Maintain a valid payment method on file
-
Keep your login credentials secure
You are responsible for all activity under your account.
3. Vehicle Acceptance Policy
To maintain service quality and market integrity:

Vehicles must be running and in sellable condition unless clearly disclosed

Mileage, condition, title status, and history must be accurate
-
Salvage or rebuilt vehicles must be properly repaired and disclosed
-
Vehicles must be legally transferable
Atoban reserves the right to decline, pause, or remove any listing at its sole discretion.
4. Fees & Payments
Setup Fee
A $99 one-time setup fee is required to activate a managed listing.
This fee covers professional listing setup, advertising placement, and vehicle history reporting.
The setup fee is non-refundable once services begin.
Success Fee
A 3% success fee applies if your vehicle sells to a buyer introduced through Atoban.
The success fee is charged on the confirmed date of sale.
Payment Authorization
By using Atoban’s services, you authorize Atoban to securely store your payment method and automatically charge applicable fees.
All fees are final and non-refundable unless otherwise required by law.
5. Seller Responsibilities
You agree to:

Provide truthful and complete vehicle information

Disclose known defects, damage, or title issues

Notify Atoban within 24 hours if your vehicle sells or is withdrawn

Not circumvent Atoban by selling directly to an Atoban-introduced buyer to avoid fees

Comply with all applicable local, state, and federal laws
Failure to comply may result in listing removal, fees, or account termination.
6. Listing Management & Pricing
Listings are managed for a defined period, generally 45 days, subject to market response.
Atoban may recommend pricing adjustments based on buyer feedback and market data.
If pricing adjustments are declined, Atoban may pause or discontinue active listing management.
Atoban does not guarantee outcomes.
7. Communications
By providing your contact information, you consent to receive:

Transactional emails and messages

Listing updates and buyer activity notifications

Service-related communications
Marketing communications are sent only if you opt in and can be stopped at any time.
8. Disclaimers
Atoban does not provide:

Legal advice
-
Tax advice
-
Financial or investment advice
You are solely responsible for evaluating offers and completing transactions.
9. Limitation of Liability
To the maximum extent permitted by law:

Atoban is not liable for disputes between buyers and sellers

Atoban is not responsible for vehicle condition, misrepresentation, or buyer conduct

Atoban’s total liability shall not exceed the fees paid to Atoban for the applicable listing
10. Chargebacks & Misuse
If you dispute a valid charge and Atoban prevails, you agree to reimburse:

Payment processor chargeback fees

A 3% administrative fee
Fraud, misrepresentation, or misuse may result in removal of listings and account termination.
11. Dispute Resolution & Governing Law
These Terms are governed by the laws of the jurisdiction where Atoban is registered.
Disputes must first be attempted to be resolved informally.
If unresolved, disputes shall be resolved through binding arbitration.
12. Termination
Atoban may suspend or terminate access to the Website or services at any time for violations of these Terms or misuse of the platform.
13. Changes to Terms
Atoban may update these Terms at any time. Updates take effect upon posting. Continued use of the Website constitutes acceptance of the revised Terms.
